What is Succession?
Succession proceedings are filed to settle the estate of a deceased person and transfer the estate property to the surviving heirs after debts are paid. Other reasons for opening a succession include:
Transfer real estate owned by the deceased
Limit the liability for the debts of the deceased
Resolve legal claims of the deceased
Manage property inherited by minors or stepchildren
Manage the affairs of a business owned by the deceased.
What is Probate?
If your loved one passes away without an estate plan, or if their will becomes disputed, their assets will enter probate. Probate is a court-supervised proceeding that will determine how your loved one's assets will be distributed. At the Law Offices of Charles Bull, I will help you navigate the complex world of Louisiana probate law. I will advocate for you and strive to see that your rights and the wishes of your departed loved one are honored by the court. What is Estate Administration?
Suppose someone owns assets located in the state of Louisiana, and that person passes away. In that case, the death certificate, the will (if there is one), and the person’s estate holdings must be passed through succession or probate before any distribution of the assets can occur. When legal disputes arise, the court may appoint an administrator to collect and inventory assets, manage assets, inventory creditor claims, and pay the deceased’s debts. For each step taken, the full administrator must obtain court approval.
If all of the heirs agree, the court can change the court's full administration to an independent administration so that the heirs can choose an estate administrator of their choosing that doe not require the court's approval for every step taken. An independent estate administrator can reduce succession expenses and delays in resolving estate issues and property distribution.
I have more than 45 years of experience in estate administration, and I leverage that experience to get the desired results for my clients. I will listen to you to find out your concerns and what is most important to you. I’ll answer all your questions in an easy-to-understand manner. If you decide to move forward, I will work with you to open a succession and develop an estate administration plan to ease your grief and move through the probate process as quickly and smoothly as possible.
